Terms of use

Draft for legal review. These terms are published for the waitlist site and will be finalised with counsel before public launch. Partner agents are bound by a separate referral agreement accepted in the agent portal.

1. Who we are

greatrealestateagents.com.au ("the site") is operated by [entity name] (ABN [ABN]) ("we", "us"). By using the site you agree to these terms.

2. What the site is

The site publishes rankings of real estate agents by suburb, agent and agency profiles, market data, guides and a facility for vendors to request proposals from agents. Rankings are computed by the formula on the methodology page from the data sources it lists. "Best" means highest on that formula and nothing more.

3. What the site is not

The site does not provide legal, financial, tax or valuation advice, and does not recommend any agent for any property. Rankings, profiles and market data are information to help you make your own decision. Commission and fee figures in guides are typical ranges published by third parties and are labelled as such; they are not quotes and not our data. Agents' licence status is shown as at the date we last checked it; verify it with the state regulator before engaging an agent.

4. Independence and partner agents

Some agents pay us a referral fee when a sale referred through the site settles. Those agents are labelled "Partner: pays a referral fee on settlement". The fee is paid by the agent, cannot be passed on to the vendor, and is not an input to the ranking. We do not sell placement of any kind.

5. Requesting proposals

When you request proposals you consent to us sharing your details with the agents you select, up to three, as described in the privacy policy. You must be the owner of the property or authorised by the owner. You agree to receive transactional messages about your enquiry. Any agreement you make with an agent is between you and the agent; we are not a party to it and do not negotiate commission.

6. Agents and claimed profiles

Agents may claim their own profile only. You must hold the licence you state, provide accurate information, and correct it when it changes. Claiming a profile does not affect your ranking. Receiving vendor enquiries requires acceptance of the referral agreement and the disclosure acknowledgement for the relevant state. We may suspend or remove a claimed profile for providing false information, misusing vendor details or breaching the referral agreement.

7. Reviews

Reviews may be submitted only by a person who has had a genuine transaction with the agent. Reviews must be honest and must not be defamatory, discriminatory or in breach of any law. We moderate under the review policy: we do not remove reviews for being negative, agents may reply publicly, and we remove reviews that are fake, misdirected or unlawful. By submitting a review you grant us a licence to publish it on the site.

8. Acceptable use

You must not scrape, copy or republish the site's data in bulk, interfere with its operation, submit false enquiries or reviews, or use the site to harass any person. Automated access is governed by our robots.txt and the bot page.

9. Intellectual property

The site's design, text, rankings and compilations are ours or licensed to us. Market data is used under licence from its providers and may not be extracted. Review text remains the property of its author. You may link to any page.

10. Liability

To the extent permitted by law, including the Australian Consumer Law, we exclude liability for any loss arising from use of the site or reliance on its content, and our liability for any guarantee that cannot be excluded is limited to resupplying the service. Nothing in these terms excludes rights you have under the Australian Consumer Law.

11. Changes and law

We may change these terms by posting the new version with its date. These terms are governed by the law of Queensland and you submit to the jurisdiction of its courts.
